Thomas Stern é académico do direito e especialista em regulação, com quase duas décadas de experiência profissional em direito europeu dos mercados financeiros e supervisão bancária transfronteiriça. Antes de integrar a Bergt Law, exerceu diversas funções séniores na Autoridade do Mercado Financeiro do Liechtenstein (FMA), mais recentemente como responsável pela divisão de resolução de bancos e empresas de investimento e, anteriormente, como responsável adjunto da supervisão bancária.

A sua prática centra-se no direito bancário e dos mercados financeiros do Liechtenstein e da Europa, em especial em autorizações, registos e matérias prudenciais ao abrigo de MiCAR, PSD2, MiFID II e CRD/CRR. Aconselha modelos de negócio regulados desde a conceção estratégica e entrada no mercado até à compliance contínua, governance e interação com autoridades de supervisão.

Governance, compliance & diálogo com supervisores

Apoio em governance, compliance, fit & proper, sistemas de controlo interno, organização regulatória e comunicação estruturada com autoridades, incluindo matérias transfronteiriças.

Reestruturação, recovery & resolution

Especialização em reestruturação empresarial, direito preventivo da insolvência e regimes de recovery e resolution, incluindo recovery planning, early intervention, resolution planning e gestão de crises.

Investigação, legislação & comités europeus

Docência em universidades europeias, cerca de 100 publicações especializadas, comentários jurídicos e obras editadas, juntamente com ampla experiência em legislação, standards e política de supervisão europeia. O seu percurso inclui ainda participação em órgãos de especialistas da Comissão Europeia, EBA e SSM.

Thomas Stern é historicamente o primeiro jurista a receber uma habilitação (venia legendi) em Direito no Liechtenstein. A sua autorização de docência abrange direito bancário e dos mercados financeiros, incluindo os fundamentos jurídicos europeus e do EEE.

A sua abordagem científica, baseada em evidências e orientada por dados complementa o método da Bergt Law: sophisticated and sustainable legal solutions na interseção entre regulação, inovação, governance e estabilidade financeira.
