Thomas Stern es jurista académico y experto en regulación con una trayectoria profesional de casi dos décadas en derecho europeo de los mercados financieros y supervisión bancaria transfronteriza. Antes de incorporarse a Bergt Law, ocupó varios cargos directivos en la Autoridad del Mercado Financiero de Liechtenstein (FMA), más recientemente como jefe de la división de resolución de bancos y empresas de inversión y anteriormente como subdirector de supervisión bancaria.

Su práctica se centra en el derecho bancario y de mercados financieros de Liechtenstein y de Europa, especialmente en autorizaciones, registros y cuestiones supervisoras en el marco de MiCAR, PSD2, MiFID II y CRD/CRR. Asesora modelos de negocio regulados desde su diseño estratégico y acceso al mercado hasta el cumplimiento continuo, la gobernanza y la interacción con las autoridades supervisoras.

Autorización y regulación financiera

Asesoramiento sobre acceso al mercado, autorización, registro, clasificación regulatoria y supervisión continua de bancos, empresas de inversión, proveedores de servicios de pago y otros intermediarios financieros, especialmente bajo MiCAR, PSD2, MiFID II y CRD/CRR.

Gobernanza, compliance y diálogo supervisor

Apoyo en gobernanza, compliance, fit & proper, sistemas de control interno, organización regulatoria y comunicación estructurada con autoridades, también en asuntos transfronterizos.

Reestructuración, recuperación y resolución

Experiencia especializada en reestructuración empresarial, derecho preventivo de insolvencia y regímenes de recuperación y resolución, incluida la planificación de recuperación, intervención temprana, planificación de resolución y gestión de crisis.

Investigación, legislación y comités europeos

Docencia en universidades europeas, alrededor de 100 publicaciones especializadas, comentarios jurídicos y obras editadas, junto con una amplia experiencia en legislación, normas y política supervisora europeas. Su trayectoria incluye asimismo la participación en órganos de expertos de la Comisión Europea, la EBA y el SSM.

Thomas Stern es históricamente el primer jurista al que se concedió una habilitación (venia legendi) en Derecho en Liechtenstein. Su venia abarca el derecho bancario y de mercados financieros, incluidas sus bases jurídicas europeas y del EEE.
